The winner will be the candidate with the most votes when we perform the count. This will be within 3 hours of the time given on the Site for the end of the election. This means the winner cannot be disputed due to timing issues.
The agreement below only applies if you become Site Administrator.
TERMS AND CONDITIONS
You guarantee to the CITY MEDIA foundation that you hold all rights to accept this agreement. If the laws of your country of residence or the country from which you are accessing the SITE stipulate that you are prohibited from accepting it or you are not of the legal age required to enter into the present agreement, ensure that you are acting in compliance with these laws.
These Terms and Conditions concern the Internet Site (hereafter designated “the SITE”) which the CITY MEDIA foundation (hereafter designated “FCM”) is dedicating to Itauna (Brazil).
1. Scope of these Terms and Conditions
The purpose of these terms and conditions is to define the conditions and procedures the person authorized to administrate the SITE and other persons invited by this person to administrate the SITE (hereafter designated as “the Administrators”) are bound to as long as they use the SITE as Administrators.
2. Use of the SITE
The Administrators can freely manage videos to be published on the SITE as well as to manage the “links” area of the SITE and in accordance with section 3 hereof.
- The Administrators can post videos themselves and select those they wish to publish from amongst those put forward by Internet users.
- The Administrators can select the image used for the SITE background, the image displayed on the City.vi website plus the links towards other Internet sites they choose.
Companies and professionals with offices or premises in Itauna can register on the relevant page of the SITE.
3. SITE content and compliance
The City.vi network will provide strong international promotion and the SITE users will be of various origins and cultures. Since the City.vi network websites are not intended to shock, offend or provoke, all content published on the SITE must comply with commonly internationally accepted standards of morality.
In particular the following must not be published on the SITE:
- violent images,
- content of a sexual nature,
- acts of an illegal and reprehensible nature,
- content depicting people being injured, attacked or humiliated,
- accidents, cadavers or other material of this type,
- content which causes a prejudice to third parties, their private life, their reputation, their property or their intellectual property rights,
- speeches or images inciting hatred, which attack or invalidate a group by reason of their race, ethnic origin, religion, handicap, gender, age or sexual identity or orientation.
In addition, the SITE content shall be intended to mainly offer his visitors information of public interest, directly concerning ItaĂşna.
The Administrators must demonstrate a real motivation to keep SITE content up to date and cover the widest possible set of information of public interest concerning ItaĂşna.
The Administrators will manage the SITE content in accordance with these terms and conditions of use. To this end, the Administrators will ensure before publication on the SITE that videos, their titles, images, text and sites referenced in the “links” part comply with these terms and conditions of use.
The Administrators are therefore solely responsible for the nature of the content published on the SITE.
FCM is not responsible for checking the content of the SITE but reserves the right to withdraw content published on the SITE if it does not comply with these terms and conditions.
4. Copyright
The authors of videos published on the SITE retain their intellectual property rights.
The Administrators may not use published videos for any purpose other than that provided for by the SITE without permission of the author.
The Administrators are responsible for the publication on the SITE of images used as the SITE background as well as videos posted by themselves and must ensure beforehand this complies with the usage desired by their author.
Videos which are determined not to comply with copyright shall be subject to the conditions of use desired by their true authors. FCM is not responsible for this but reserves the right to withdraw any video from the SITE which does not meet the conditions desired by its author.
In this case, the Administrators concerned will be informed by email.
5. Financial Conditions
The income from business accounts created on the SITE will be shared: two-thirds (2/3) for the Administrators and one third (1/3) for FCM. The Administrators have the possibility to earn extra income by posting some promotional videos and also by referencing other sites on the links page.
6. Access to the SITE
FCM works with operators for SITE hosting and broadcasting its content.
However, in the event of temporary unavailability, FCM shall not be held responsible.
If the SITE is unavailable for more than 2 consecutive hours, the Administrators are invited to inform FCM so that it can take steps to re-establish the service as soon as possible.
7. SITE Evolution
FCM is constantly working to offer the best experience possible to users of the City.vi network. To do that, the design and functionality of the SITE may change.
However, FCM undertakes to maintain direct access to the content of the tour, events, news and links areas.
The advertising spaces may also change from time to time to optimize use of the SITE. Consequently, the Administrators accept slight changes of your remuneration which may arise from this. For any changes FCM will make, FCM will try to satisfy Administrators with new SITE's design, functionalities and possibilities of earnings.
8. Intellectual Property
The Administrators undertake not to distribute all or part of the SITE, not to assign rights over the SITE, not to modify or change any part of the SITE and not to attempt to or actually bypass, deactivate or disrupt in any other manner any SITE function.
These terms and conditions may in no way be interpreted as conferring any rights whatsoever concerning the SITE onto the Administrators.
9. Termination of use of the SITE by the Administrators
The Administrators can stop running the SITE whenever they want. In such case they will have to mention it to FCM by email.
Additionally, the Administrators undertake to operate the SITE in respect with section 3 hereof, in a responsible manner and not to arbitrarily refuse to publish videos. If after several such notifications the Administrators persist in not meeting these commitments, FCM shall be able to terminate use of the SITE by the Administrators without prior notice.
FCM will not be liable for any indemnities whatever agreements the Administrators may have entered into with other parties.
10. Language
These terms and conditions are written in English. In the event of a dispute only the English language version has legal force, to the exclusion of any translations provided by FCM as a matter of convenience.
